FCC Personal Radio Service Enforcement Actions

These letters were written by FCC Special Counsel Riley Hollingsworth of the FCC Enforcement Bureau office at Gettsyburg, PA or his designate in Washington D.C. The letters are based on GMRS complaints filed with his office either through the PRA or by private individuals. These letters of inquiry are sent when the FCC has reason to believe that violations of FCC Rules have occurred. These letters are an FCC public record. The text of some letters may also appear at the American Radio Relay League website if the subject of the complaint also holds an Amateur Radio Service license. The FCC may consider whether a violation of its Rules in the GMRS should also have consequences under the FCC Rules for the Amateur Service. Violations in the GMRS by Radio Amateurs may in fact be used to determine whether or not the Amateur has the requisite qualifications to remain a Commission licensee.

FCC Authority Statement

Section 308(b) of the Communications Act of 1934, as amended, 47 U.S.C. 8 308(b), gives the Commission the authority to obtain information from applicants and licensees about the operation of their station and their qualifications to remain a licensee. Accordingly, you are requested to respond to this office within 20 days stating in detail what action. you intend to take to bring your system into compliance with the rules. In an inquiry of this type we are required to notify you that a willfully false or misleading reply constitutes a separate violation made punishable under United States Code Title 18, Section 1001.

FCC Station Inspection Authority

The FCC Enforcement Bureau may determine that some complaints be forwarded to an FCC Field Office for an on-site inspection. The FCC has the authority to inspect any radio station during that station's hours of operation - whether or not the station is licensed or unlicensed and without regard for the convenience of the station operator.


September 23, 2005: Mr. Hollingsworth reports that letters from his current cases will go out between September 23 and October 10. Two PRA cases have been referred to Field Offices. Copies of letters will be posted after the PRA allows recipients time to receive their letters. The PRA received two complaints by mail and has made sure those were forwarded to Hollingsworth.

October 28, 2005: Letters went out.

October 2005

November 28, 2005: Letters for new cases since October will be sent between November 28 and December 30. Letters will appear on this site after the FCC believes sufficient time has elapsed for the subjects of the complaints to have received their correspondence.

January 11, 2006: December 2005 letters were delayed at the FCC while the mechanics of a GMRS reporting system were set up with the headquarters office in D.C. Mr. Hollingsworth will have help at FCC HQ dealing specifically with letters for unlicensed use by ineligible licensees. Letters for active cases assigned to Hollingsworth will go out as he completes those this month. High profile Amateur Radio cases kept him very busy through December.

February 2, 2006: Several letters regarding unlicensed operation were mailed from the FCC this week. Some cases were referred to Field Offices. When we receive copies of the letters the letters will be posted.
